Ticketmaster the gift card programme for recycling mobile phones and iPods.

Please read these terms and conditions carefully before sending us your phone(s). You should understand that by submitting an order, you agree to be bound by these terms and conditions.

You should print and keep a copy of these terms and conditions for future reference.

In confirming your order you will need to tick the box indicating that you accept these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to place an order via our site.

We recommend you take note of your IMEI number in case there is a problem with your order. Your IMEI number can be found at the back of your phone under the battery or by typing in *#06#

Your mobile phone

Each mobile phone and iPod sold by you should match the make and model stated when registering your order and meet the following conditions:

  1. The phone or iPod must turn on and off
  2. The phone or iPod must be fully functional
  3. The screen must be working and intact
  4. The battery must be included
  5. The phone or iPod must not be crushed, liquid-damaged, stolen/broken a counterfeit or fake.
  6. The phone or iPod must be original and meet the manufacturer’s original specifications.

A counterfeit or fake device is defined as any device found not to be original or of original specification, altered or modified from the original manufacturer’s specifications and design.

Any counterfeit or fake mobile phones returned will be held by Ticketmastermobile.co.uk and reported to the police. No payment will be made and the phone(s) will not be returned.

Damaged phones (revised price)

If a phone fails to meet the above terms and conditions ticketmastermobile.co.uk will propose a revised value in Ticketmaster Gift Card. The phone will be categorised into one of the following levels:

  1. Level 1 revision – if the mobile has a missing battery, the original price quoted when registering with ticketmastermobile.co.uk will be price revised by 10%
  2. Level 2 revision - if the mobile has a missing battery and/or buttons or aerial or if the cover is broken, missing or insecure, the original price quoted when registering with ticketmastermobile.co.uk will be price revised by 25%.
  3. Level 3 revision – if the mobile has a bleeding LCD/ screen (the screen is leaking or has leaked on the inside) or fails to turn on the original price quoted when registering with ticketmastermobile.co.uk will be revised by 50%
  4. Level 4 revision – if the mobile phone fails in both the above categories, the original price quoted when registering with ticketmastermobile.co.uk will be revised by 75%. If the iPod fails in the above 2 categories then no value will be paid.
  5. Level 5 revision - if the mobile is liquid damaged, stolen/blocked or the phone is in pieces no value will be paid.

By submitting an order through our site you warrant that the phone(s) or iPod(s) comply with these terms.

Any counterfeit or fake mobile phones returned will be held by Ticketmastermobile.co.uk and reported to the police.  No payment will be made and the phone(s) will not be returned.

Any mobile phones that are sent to ticketmastermobile.co.uk and do not have a value will be recycled in the most environmentally friendly way.

Please remove any phone locks that require a pin code. Handsets that are received and cannot be fully tested because of a phone lock will not be processed for payment and can not be returned.

Pricing

Values offered on our website are subject to change at any time without notice.

When your order has been placed, the prices quoted are guaranteed for 14 days. (This is the date on which we send you a confirmation letter and Freepost envelope or from the date that you print a freepost label) If your phones are received after 14 days from the 'issue letter date' the up-dated, current prices will apply.

If the mobile(s) or iPod(s) received differs to the handset(s) registered on-line, the order will be processed based on the handset(s) received, not the handset(s) registered.

Ticketmaster will have the final decision on all mobile phone and iPod values.

Payments

When we receive your order, we will check that it is complete and that it meets our terms and conditions. Providing it does, we will action payment within 7 working days.

Please Note:Payment via gift card can only be made to the name, address and details provided upon registration.

If your gift card is faulty inform us immediately and send the faulty card to the following address:

If the damaged gift card is not received by us, a cancellation fee will apply and will be deducted from the re-issued gift card value.

If you have lost your gift card, this is not reimbursable.

Postage

Please use the Ticketmaster Freepost envelope or label provided. Unfortunately, other than when we arrange a courier collection (see below), we do not accept responsibility for non-delivery of phones or damage in transit. We therefore recommend that you send any high value units via registered post to ensure successful delivery. Mobile phones that are sent to ticketmastermobile.co.uk unfortunately cannot be returned.

Please ensure that you are happy to send the phone to us and that it is within your rights to do so. Unfortunately ticketmastermobile.co.uk cannot return handsets or iPods under any circumstance.

Consumers

By placing an order through our site, you warrant that:

  1. You are resident in Great Britain or Northern Ireland; and
  2. You are accessing our site from that country
  3. You are legally capable of entering into a binding contract; and
  4. You are at least 18 years old; or
  5. If you are under 18 years of age, that you have obtained your parent’s or guardian’s consent to sell your phone to us for the sum indicated via our website.

You and your parents or guardians release us of any liabilities or claims that may arise if you send the phone to us in breach of this warranty.

If you deal as a consumer any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.

For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract in the course of a business, nor holds himself out as doing so, as defined by the Unfair Contract Terms Act 1977.

Please note:

  1. You are responsible for cancelling any airtime contract linked to each handset. We are not responsible for any call costs arising before, or after, receipt of your handset, or arising from any other circumstances whatsoever.
  2. Please remove SIM cards before sending us your mobile. Any SIM cards received by us will be destroyed, and so obviously cannot be returned. (We will dispose of them appropriately.) We accept no liability in the event that any phone that has been sent with its SIM card is lost and charges are then incurred. You shall continue to be responsible for such charges.
  3. Please ensure all personal data is removed from handsets before sending them to Ticketmastermobile.co.uk. This includes but is not limited to all personal details, SMS, photos, videos, games, songs or other data. Ticketmastermobile.co.uk will not accept responsibility for the security, protection, confidentiality or use of such data. By sending your mobile phone to us you agree to release us from all and any losses, claims or damages with respect to the data enclosed or stored therein or on any media used in conjunction with the mobile phone.

How The Contract Is Formed Between You And Us

Our site is only intended for use by people registered with us and resident in Great Britain and Northern Ireland. At our complete discretion we may accept or reject orders from people outside of these territories.

Your contract with us will be formed when we receive your order. It will incorporate these terms and conditions.

You must own all rights, title and interests in any phone(s) that you send to us.

Ownership of the phone(s) will only pass to us when we receive the phones, in accordance with these terms and conditions, and we have dispatched payment to you, when, hence, a contract will be formed.

The contract between you and us is binding on you and us and on our respective successors and assigns.

You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

You may cancel the contract with us at any time up to the time when you send us the phone ("cooling- off period"), providing:

  1. the contract was negotiated and concluded exclusively by means of distance communication (including, but not limited to, telephone, letter, fax or email); and
  2. you are a natural person acting outside the purposes of any business.

When cancelling during the cooling-off period, you need not give us any reason for cancelling the contract, nor will you have to pay any administration charges.

To cancel the contract you must notify us in writing.

This contract cannot be cancelled once our payment has been issued to you.

Events Outside Of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.

Promotional Codes

  1. Offer only open to Ticketmaster employees.

  2. This promotion is open to UK only and valid for those mobile phones registered and returned between the 23rd July and ends the 31st August 2009.

  3. The £5 offer is available on a per order basis and not per mobile.

  4. The offer is only available if your mobile is in full working order, your order contains a mobile that is listed and has a value of £6 or greater on ticketmastermobile.co.uk

  5. The offer is open to a maximum of 3 orders per customer/household

  6. When your order has been placed, the prices quoted are guaranteed for 14 days. If your phone(s) are received after 14 days from registration you will receive the current online price.

  7. All customers using a promo code must return their goods within 30 days of the offer end date. Goods received after this will be processed and no bonus amount will be added.

  8. Freepost envelopes returned must have their tear-off form completed to be eligible. Photocopies, incomplete and illegible entries will not be accepted. No responsibility will be accepted for entries lost, damaged or delayed in the post. Proof of posting will not be accpeted as proof of delivery.
Entrants agree to be bound by the terms & conditions listed and by any other requirements set out in the terms and conditions on ticketmastermobile.co.uk. All instructions form part of the rules.
